Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of this website and all services provided by Kinzua Mountain Outfitters, LLC (“KMO,” “we,” “our,” or “us”). By accessing this website or booking services, you agree to these Terms.
1. Services
KMO provides guided hunting experiences, outdoor recreational services, and related merchandise. All hunts are subject to wildlife availability, weather conditions, land access, regulatory limitations, and safety considerations.
We do not guarantee harvest success.
All hunts are conducted in compliance with applicable Oregon Department of Fish and Wildlife (ODFW) regulations. Clients are responsible for securing required licenses and tags unless expressly stated otherwise in writing.
2. Eligibility
Participants must:
• Be at least 18 years of age, or have signed parental/guardian consent
• Be legally permitted to possess firearms where applicable
• Comply with all federal, state, and local hunting regulations
KMO reserves the right to refuse service to anyone who violates safety rules or legal requirements.
3. Booking & Payment
A booking is not confirmed until a deposit or full payment is received.
• Deposits may be non-refundable unless otherwise stated in writing
• Final payment deadlines will be provided at time of booking
• Prices are listed in U.S. Dollars (USD)
• KMO reserves the right to adjust pricing prior to confirmed booking
Failure to make timely payments may result in cancellation of the reservation.
4. Cancellations
Hunting Packages:
Cancellation terms will be outlined in your written booking agreement. Unless otherwise specified, deposits are non-refundable. Date transfers are not guaranteed and are subject to availability.
Merchandise:
Returns accepted within 14 days of delivery if unused and in original condition. Return shipping costs are the customer’s responsibility unless the item is defective.
5. Assumption of Risk & Limitation of Liability
Hunting and outdoor activities involve inherent risks including but not limited to:
• Firearm discharge
• Wildlife encounters
• Rough terrain and environmental hazards
• Weather-related risks
• Physical exertion and travel
By participating in any activity with KMO, you voluntarily assume all inherent risks.
KMO shall not be liable for injury, death, property damage, or loss arising from participation in outfitting services, except where prohibited by law.
All clients are required to sign a separate liability waiver prior to participation.
6. Merchandise Sales
All merchandise is sold “as is” unless otherwise stated. KMO is not responsible for misuse of products.
Title and risk of loss transfer upon shipment.
7. Intellectual Property
All content on this website — including logos, branding, text, photos, videos, and design elements — is the property of Kinzua Mountain Outfitters, LLC and is protected under U.S. intellectual property laws.
Unauthorized reproduction or commercial use is prohibited.
8. Website Use
You agree not to:
• Use the website for unlawful purposes
• Attempt to disrupt site functionality
• Access restricted systems or data
We reserve the right to restrict or terminate access at our discretion.
9. Privacy
Your use of this website is also governed by our Privacy Policy.
10. Governing Law & Venue
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
Any legal action arising from services or website use shall be brought exclusively in state or federal courts located within Oregon.
11. Force Majeure
KMO shall not be liable for failure to perform due to causes beyond reasonable control, including but not limited to natural disasters, wildfires, government action, regulation changes, or access restrictions.
12. Changes to Terms
We may update these Terms at any time. Continued use of the website constitutes acceptance of the revised Terms.
